Additional Benefits of Social Security Contributions

In the past days, a new Decree issued as complement to that issued on May 7, 2009 authorizes that certain social security contributions´ payments may be paid in installments as a way to support companies and economic sectors affected by the sanitary contingency of the past few weeks. Contributions included are those incurred in May and June 2009.

 

The suggested mechanism is the following:

 

A 50% payment of the work risks, illness and maternity, disability and life and nursery and social benefits may be paid in five installments.  Besides that established in the May 7 decree, the calculation of this amount shall be made, in all cases, once the twenty percent of the social security fees –maximum 35,000 pesos- plus the corresponding interests at an annual rate of 6.5%, are subtracted. Mentioned insurance that are incurred during April 2009, shall be exempted from said percentage for the extemporaneous payment of fines.

 

It is important to mention that employers may ascribe to these benefits, as long as they are have duly paid the rest of the fees that are not subject of the benefits contained in the Decree.

 

Finally, it is important to mention that the benefits established in the Decree shall not derive in any reimbursement or offset. The Technical Committee of the IMSS may issue other general regulations and provisions that may be necessary for the correct application of the Decree; we will be reviewing them in such case.
