Experience

Gerardo Valencia joined Cuesta Campos in 2014. With over 15 years of experience in Labor Law and Social Security, he has focused his practice in advising and counseling important multinational and local companies from different industries, from the key strategic aspects to the fulfillment of regulations, including: incorporation of companies in Mexico and foreign subsidiaries, collective negotiations, implementation of internal processes for regulating employee’s relations, merger and acquisitions assessments, review of schemes for contracting with outsourcing and its application according to labor and tax rules, negotiation with suppliers to verify and require compliance with obligations, Social Security counseling, including actions for nullity before Federal Court of Justice for Tax matters, analysis and implementation of employer substitution processes, training for high-level officials in the administration of their personnel, as well as the solution of disputes through outside trial agreements, such as individual and collective litigation before Labor boards and courts throughout the country.

Gerardo actively participates and has been speaker at business and industry forums, such as: Chambers of the Manufacturing Industry, Japan Chamber of Commerce and Industry in Mexico, Mexican Employer’s Association (COPARMEX), ANADE, where he has presented topics to union members about the preparation and fulfillment of norms and obligations at the workplaces, recommendations during work inspections, amendments to the Federal Labor Law, analysis on outsourcing services, among others. 
Mr. Valencia has authored articles on labor law in recognized publications such as the Association of Corporate Counsel, Global City Media (The Global Legal Post), among others, has been chosen as a recommended lawyer for 2018 by Employment Law Experts.

Before his incorporation to Cuesta Campos he worked as partner in an important law firm specialized in Labor Law, Bureaucratic, Notarial, Amparo, Criminal and Litigation in Guadalajara.

Preparation of legal strategy to avoid a strike for transnational companies, such as Nike, Electricfil, Huntsman, Ooyala, Crocs, Board Longyear and others.

Labor Union negotiations for the signing of a collective bargaining agreement and annual review with Nike, Electricfil, Crocs, Boart Lonyear, Yushiro, Yamazen, Honda Logistics, Electro Ensambles de Acuña.

Preparation of Due Diligence for the acquisition of the Bose plant with Flextronics in San Luis Rio Colorado, as well as negotiation with employees to avoid a labor stoppage before the acquisition, verifying possible contingencies, procedures before the Labor or Tax Authority.

Preparation of Due Diligence for the acquisition of Dofesa plant by Tennant in Aguascalientes, verifying possible contingencies, procedures before Labor or Tax Authority.
